1. Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of Oraclez’s websites, products, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
- Supplemental terms. Some features may be subject to additional terms presented at the time of use; those terms are incorporated by reference and, if in conflict, control for the relevant feature.
- Organization users. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization and that “you” refers to the organization.
- Conflicts. If any order form, SOW, or enterprise agreement is in place, it will control where expressly stated.
2. Eligibility; Accounts
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement of a parent or guardian. You are responsible for your account credentials, safeguarding access, and all activities under your account.
- Account security. Keep credentials confidential; promptly notify us of suspected compromise. We are not liable for losses due to compromised accounts you control.
- Accurate information. Provide accurate, complete, and current information; promptly update changes.
- Prohibited persons. You may not use the Service if you are barred under applicable law (e.g., on U.S. sanctions lists).
3. Changes to Terms
We may modify these Terms from time to time. We will update the “Last updated” date and, where required by law, provide additional notice. Your continued use after changes constitutes acceptance of the updated Terms.
4. Description of Service
Oraclez provides a website risk analysis and scoring platform that aggregates observable and third‑party signals (e.g., OSINT) to produce analytics such as a TrustScore and module outputs. Outputs are informational and provided “as is” without warranties.
- Availability. The Service may be unavailable during maintenance, outages, or third‑party failures. We do not guarantee uninterrupted or error‑free operation.
- Third‑party dependencies. Certain features rely on external data sources and APIs; availability and accuracy depend on those providers.
- Beta/experimental features. Features marked beta may change, break, or be removed at any time.
5. Acceptable Use
You agree not to, and not to enable others to: (a) use the Service for unlawful, infringing, or harmful purposes; (b) probe, scan, overload, or disrupt the Service; (c) reverse engineer or circumvent security; (d) impersonate others or misrepresent affiliation; (e) upload or transmit malware or spam; (f) harvest data in violation of applicable law; (g) use outputs to unlawfully profile, discriminate, or violate privacy or intellectual property rights.
- Automated access. Do not scrape or crawl the Service without express written permission, except as permitted by robots.txt or applicable law.
- High‑risk activities. Do not use outputs in life‑critical or high‑risk contexts (e.g., medical devices, aviation, nuclear) where failure could result in injury or death.
- Sensitive data. Do not input personal data you do not have rights to process; avoid sensitive data unless explicitly allowed in a separate agreement.
- Rate limits. Respect documented or implied rate limits; do not create excessive load or bypass controls.
6. User Content; Feedback
You retain ownership of content you submit. By submitting content, you grant Oraclez a nonexclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your content solely to operate and improve the Service. Providing feedback gives us permission to use it without obligation.
7. Intellectual Property
Oraclez and its licensors retain all right, title, and interest in the Service and related intellectual property. Oraclez grants you a limited, nonexclusive, revocable license to use the Service solely in accordance with these Terms.
8. Third-Party Services
The Service may link to third-party sites or incorporate third-party services. Oraclez is not responsible for third-party content or performance.
9. Risk Scores; No Advice
TrustScores and outputs reflect probabilistic assessments based on observed signals. They are not legal, financial, or security advice. You remain solely responsible for decisions based on outputs.
10. DMCA
We respect intellectual property rights. Submit DMCA notices to the contact listed in Section 22 with appropriate detail.
11. Privacy
Our Privacy Policy describes how we handle personal data. You represent that you have all rights necessary to submit data to the Service.
12. Payment
Paid plans may require fees disclosed in an order form or subscription plan. Fees are nonrefundable except as required by law.
13. Termination
We may suspend or terminate access at any time for violating these Terms or if continued use poses risk. Upon termination, you must cease use and delete any confidential materials.
14. Disclaimer
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ORACLEZ DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
15. Limitation of Liability
To the fullest extent permitted by law, Oraclez’s aggregate liability will not exceed the greater of $100 or the amounts paid in the twelve months preceding the claim. Oraclez is not liable for indirect, consequential, or punitive damages.
16. Indemnification
You will defend and indemnify Oraclez against claims arising from your misuse of the Service, violation of these Terms, or infringement of third-party rights.
17. Arbitration; Class Waiver
Disputes will be resolved by binding arbitration under the Federal Arbitration Act. You waive class actions and agree to bring claims individually. Arbitration will occur in San Francisco County, California.
18. Governing Law; Venue
These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Courts in San Francisco County have exclusive jurisdiction for matters not subject to arbitration.
19. Export Controls; Sanctions
You agree to comply with U.S. export laws and sanctions. You may not use the Service if you are located in, or are a national of, a prohibited jurisdiction.
20. U.S. Government Rights
If you are a U.S. government entity, the Service is provided as “commercial computer software” subject to standard licensing terms.
21. Beta Features
Beta features are provided for evaluation only and may change or terminate without notice. They are provided “as is” and do not create support obligations.
22. Miscellaneous
If any provision is invalid, the remainder remains in effect. Failure to enforce is not a waiver. You may not assign these Terms without consent. We may assign to affiliates or in connection with a merger.
